TITLE III – DISCIPLINARY REGIME, OFFENSES AND SANCTIONS
Chapter 1 – Scope of application, offenses and sanctions

Article 7 – Scope of Application

This Title applies to all season ticket holders, employees, spectators, and fans of Córdoba C.F., provided the offenses are committed in the facilities and surrounding areas and/or on the occasion of any sporting event, competition, or show organized or directly managed by the Club or, where appropriate, by delegation of any body, federation, or entity.

This Title also applies when the offense consists of any act, manifestation, or statement that may entail incitement or create a climate favorable to violence or aggressiveness, even if it occurred outside sports venues or before or after the events mentioned.

Sanctions resulting from offenses committed through the use of a season ticket card or a transferred ticket to access events organized or managed by the Club will apply to the season ticket holders, employees, spectators, and fans of Córdoba C.F., or to the absent transferring holder. To safeguard the image, prestige, and social standing of the Club, behaviors considered offenses in these Regulations will receive the same disciplinary treatment when committed by a season ticket holder or employee in connection with events in which our teams participate as visitors in facilities not belonging to Córdoba C.F.

The sanctions arising from disciplinary offenses regulated in these Regulations are independent of any possible administrative or criminal sanctions determined by the competent administrative or judicial authorities.

Article 8 – Very Serious Offenses

2. Unauthorized intrusion onto the field of play or into areas to which spectators are prohibited from accessing.
3. Attempts at aggression and physical assaults against players, referees, directors, coaches, Club employees, and any person linked to the organization and/or development of the event, as well as attendees and spectators.
4. Active participation in altercations, fights, or public disorder in sports venues.
5. Threats and insults directed at players, referees, directors, coaches, Club employees, or any person linked to the organization and/or development of the event, as well as attendees and spectators.
6. Non-compliance with the obligations of access and stay established in these Regulations.
7. Non-compliance with an evacuation order decreed by the Club’s security managers or the security forces.
8. Expressions or insults implying any type of discrimination based on race, religion, personal beliefs, sexual orientation, or disability, or that offend the dignity of natural or legal persons or any institution, whether public or private (always considered very serious).
9. Non-compliance with sanctions imposed regarding violence, racism, xenophobia, and intolerance in sport, in accordance with these Regulations.
10. Creating or promoting, through statements, public manifestations, or any other means (including social networks), a climate favorable to aggression or violent acts, or any of the other activities considered an offense in these Regulations, even if committed before or after the events or outside sports venues.
11. Displaying in sports venues banners, flags, symbols, or other insignia with messages inciting violence, that are offensive, contain slurs, threats, or insults, or imply any type of discrimination based on race, religion, personal beliefs, sexual orientation, or disability, or that offend the dignity of natural or legal persons or any institution, whether public or private, or that constitute an act of manifest contempt toward participants in the event.
12. Chanting or uttering sounds or expressions that incite violence, are offensive, contain slurs, threats, or insults, or imply any type of discrimination based on race, religion, personal beliefs, sexual orientation, or disability, or that offend the dignity of natural or legal persons or any institution, whether public or private, or that constitute an act of manifest contempt toward participants in the event.
13. Occupying seats other than those corresponding to the access ticket when, by such conduct, the decisions adopted by the Club to ensure appropriate segregation of visiting supporters have been violated or disobeyed (considered a very serious offense).
14. Ticket reselling, regardless of the legal liabilities it entails (considered a very serious offense).

Article 9 – Serious Offenses

All of the offenses mentioned in the previous article shall be deemed serious when, in the judgment of the Social Discipline Committee, there are no circumstances of harm, risk, or danger, and they have not contributed to impeding or hindering the normal development of the event. In any case, the transfer—through payment or any other consideration—of a member or season ticket card, regardless of the circumstances, shall be considered a serious offense.

Article 10 – Minor Offenses

Minor offenses are any actions or omissions by attendees at events organized or promoted by the Club that constitute non-compliance with the obligations and/or prohibitions established in these Regulations, characterized by their low seriousness or lack of intent, as well as non-compliance with any other legally established obligations regarding safety in sporting events in general. The transfer of a member or season ticket card without the Club’s express authorization shall also be considered a minor offense.

Article 11 – Offenses by Groups or Supporters’ Clubs

Offenses by groups or supporters’ clubs consist of group actions by persons linked to such groups that constitute any of the offenses set out in Articles 8, 9, and 10, irrespective of whether, individually, they might constitute crimes, misdemeanors, or administrative infractions. Official supporters’ clubs identified as authors of offensive choral chants subject to sanction may be expelled as a club recognized by the entity, regardless of any individual criminal or administrative liabilities.

Article 12 – Conduct During Travel and/or Away Matches

To safeguard the image, prestige, and social standing of Córdoba C.F., behaviors considered offenses in these Regulations shall receive the same disciplinary treatment when committed by a season ticket holder in connection with events in which our teams participate as visitors in facilities not belonging to the Club.
The above applies irrespective of administrative or criminal sanctions that may be determined by the competent authorities.

Article 13 – Sanctions

  1. The commission of the offences defined in these Regulations by the Club’s season-ticket holders, employees, spectators, or identified supporters in attendance shall result in the imposition of the following sanctions:
    1. MINOR OFFENSES: Ban on access to facilities where events organized or managed by Córdoba C.F. are held for a period between one and six months, and loss of season ticket holder status during that period.
    2. SERIOUS OFFENSES: Ban on access to sports facilities where events organized or managed by Córdoba C.F. are held for a period between six months and two years, and loss of season ticket holder status during that period.
    3. VERY SERIOUS OFFENSES: Ban on access to sports facilities where events organized by Córdoba C.F. are held for a period between two and five years, and loss of season ticket holder status during that period.
  2. Temporary loss of season ticket holder status entails the inability to exercise associated rights (such as access to facilities or commercial benefits) but does not prevent the imposition of new sanctions for further violations during the period of enforcement. No refund—total or partial—will be due for payments already made or committed for the season ticket.
  3. Without prejudice to the sanctions established, Córdoba C.F. will file the corresponding complaints with the competent judicial or administrative bodies against the alleged offender and will claim any damages suffered. While awaiting the Committee’s decision on the level of the offense, the Club will impose precautionary measures: blocking the season ticket and prohibiting access to all Club events.

Article 14 – Grading of Sanctions
In determining sanctions, appropriate proportionality must be observed between the seriousness of the offense and the sanction, graded according to the following criteria:
1. The existence of (...).
2. Recidivism, assessed by the commission—within one year—of more than one offense of the same nature, recorded by resolution (...).
3. The nature of the economic, moral, or physical damage caused and the risks borne by spectators and by the offender (...).
4. Spontaneous repentance, public apologies, and gestures expressing the intention to correct or remedy the physical or moral harm.
5. Cooperation in locating other persons responsible for violations of these Regulations.

Article 15 – Statute of Limitations
Offenses typified in these Regulations shall expire within the following periods:
1. Very serious offenses: two years.
2. Serious offenses: one year.
3. Minor offenses: six (…).

The limitation period shall begin on the day the offense was committed and will be interrupted when the initiation of disciplinary proceedings is notified to the interested party with proof of receipt.
Sanctions shall expire within the following periods:

  1. 1. Sanctions for very serious offenses: three years.
    2. Sanctions for serious offenses: two years.
    3. Sanctions for minor offenses: one year.
  2. The limitation period for sanctions shall begin when the resolution becomes enforceable.

Article 16 – Extinction of Disciplinary Responsibility
1. By serving the sanction.
2. By the limitation of offenses or of (…).
3. By the death of the person.
4. By lifting of the sanction or pardon by the Club’s Board of Directors.

Article 17 – Disciplinary Authority
The Social Discipline Committee (CDS) of Córdoba C.F. is exclusively empowered—by express delegation of the Board of Directors—to sanction offenses committed by season ticket holders, employees, spectators, and fans of Córdoba C.F. at events organized or managed by the Club, in accordance with these Regulations and applicable provisions.

Article 18 – Functions and Powers of the Social Discipline Committee (SDC/CDS)
1. Decide, in a single instance and at the request of the Board of Directors, on the opening of disciplinary proceedings. The proposal may originate from the Club’s security managers and/or the Board; in any case, it must be communicated to the Chair of the Board prior to notification.
2. Instruct, process, and resolve disciplinary files against alleged offenders, in accordance with these Regulations and applicable rules.
3. Investigate and use any admissible means of evidence to clarify the facts; the CDS may request necessary evidence from the competent authorities.
4. Adopt, where appropriate, precautionary measures in accordance with these Regulations.
5. Impose the sanctions provided to the degree deemed most appropriate, considering the nature of the facts and the circumstances of the case, in accordance with these Regulations and applicable rules.
6. Execute the sanctions imposed.

Article 19 – Composition of the Social Discipline Committee
The CDS shall consist of at least three members, appointed by the Club’s Board of Directors. Members are appointed for one year and may be reappointed for equal periods, with their position subject to revocation by the Board.
The CDS members shall elect from among themselves a Chair, a Vice-Chair, and a Secretary. Decisions are adopted by simple majority. To be appointed as a member of the Committee, all of the following requirements must be met:
1. Be of legal age.
2. Not be disqualified from holding positions in sports organizations by judicial sentence or administrative resolution.
3. Be a season ticket holder or Director of the Club. Members of the CDS shall not receive remuneration for their duties but shall be provided with the necessary means to perform them properly.

Article 20 – Adoption of Decisions by the CDS
Decisions shall be adopted by simple majority. For valid adoption, more than half of the members must be present.

Chapter 2 – Disciplinary Procedure (EN)

Article 21 – Initiation, Disciplinary Procedure, and Submission of Complaints
1. Disciplinary files shall be initiated at the request of the Club’s security managers and/or the Board of Directors. The CDS shall always have the corresponding reports at its disposal and may request additional reports at any time.
2. The CDS shall decide in a single instance—after reviewing the information provided by the Board and, where appropriate, the security managers—on the need to open disciplinary proceedings or, if appropriate, to dismiss the complaint.
3. If the CDS finds sufficient indications of the commission of any offense typified in these Regulations, it shall open the corresponding disciplinary file and inform the Chair of the Board. The decision shall be recorded in a Register of Disciplinary Files, whose opening date and the number and numbering of its pages shall have been notarized.

Article 22 – Processing of Disciplinary Proceedings
1. Once the disciplinary file has been opened and recorded in the Register, this decision shall be formally notified to the alleged offender(s). The person(s) subject to proceedings shall have ten (10) calendar days from receipt to submit allegations and evidence. During this period they have the right to review the file. Failure to submit or respond will result in being declared in default, and the CDS will impose the sanction it deems appropriate. As a precautionary measure from the moment of opening the file until resolution, the offender(s) shall be notified of a ban on access to Club sporting events.
2. The CDS shall conduct such evidentiary measures as it deems useful and relevant among those proposed by the person(s) subject to proceedings, and may, ex officio, promote any it considers appropriate for better clarification of the facts.
3. Once the period for allegations has ended, and within the following twenty (20) calendar days, the CDS shall issue the corresponding acquittal or sanctioning resolution, which shall be formally notified to the person(s) subject to proceedings.
4. Interested parties may be represented in the proceedings by a person of their choice, by simple written notification to the CDS.
5. The procedure shall be conducted in writing.

Article 23 – Enforceability of Sanctions
Sanctions imposed by the CDS are immediately enforceable. Claims or appeals do not automatically stay or suspend enforcement. However, the Board of Directors may provisionally suspend enforceability after a reasoned assessment of the likelihood of success of the appeal and the possibility of causing harm that is difficult or impossible to repair.

Chapter 3 – Appeals

Article 24 – Appeal Against CDS Decisions

Appeals may be lodged within thirty (30) calendar days of notification before the Club’s Board of Directors.

Article 25 – Appeal Against Board of Directors’ Decisions
The Board shall resolve appeals filed against CDS decisions. Decisions of the Board of Directors may be challenged before the ordinary courts. These Regulations shall enter into force on the day following their approval by the Board of Directors. Any matters not foreseen herein shall be governed by the related applicable regulations or legislation.

 Córdoba, May 10, 2022.

Regulations for Fan Clubs and Supporters’ Associations of Córdoba CF

STATEMENT OF REASONS

This Regulation arises as a consequence of the significant development of the supporters’ club movement that has expanded in recent years around Córdoba CF, not only in Córdoba and its province, but throughout Spanish territory.

For this reason, there is a need to establish regulations that lay the necessary foundations to harmonise this collection of associations and their actions aimed at promoting and spreading the Córdoba CF spirit, not only throughout the city of Córdoba and its province, but across the entire national landscape, and even internationally.

Thus, this Regulation adapts the relations between Córdoba CF, its fan clubs, and supporters’ associations.

FAN CLUBS AND SUPPORTERS’ ASSOCIATIONS

ARTICLE 1 – Definition and applicable law.

The fan clubs and supporters’ associations of Córdoba CF are sovereign and independent, non-profit groups, constituted in accordance with Article 22 of the Spanish Constitution, Organic Law 1/2002 of 22 March regulating the Right of Association, Law 4/2006 of 23 June on Associations of Andalusia, as well as the applicable current legal provisions, or, where applicable, in accordance with the laws of the country in which they have their registered office or were constituted in the case of foreign associations. Furthermore, fan clubs and supporters’ associations shall be governed by their own statutes.

ARTICLE 2 – Purpose of Córdoba CF fan clubs and supporters’ associations.

Their purpose is to encourage the support, following, and cheering of all the teams that are part of Córdoba CF, as well as to maintain, promote, and publicly project the image and brand of Córdoba CF, not only in Córdoba and its province, but also nationally and even worldwide. Likewise, fan clubs will foster unity among their own members, among all Córdoba CF fan clubs, and among Córdoba CF supporters in general, promoting, as far as possible, cultural, sporting, social, or recreational events.

ARTICLE 3 – Fan club membership status.

A “peñista” (fan club member) is any natural person who is part of a fan club or supporters’ association of Córdoba CF, who voluntarily submits to the statutes of their club, as well as to this Regulation, with the rights and duties granted by both these and the corresponding Law, and is committed to the purposes of the association.

ARTICLE 4 – Board of Directors.

Subject to the legislation in force at any given time, fan clubs registered in the Córdoba CF Official Fan Club Register must have a Board of Directors, which must consist, at a minimum, of a President, a Secretary, and a Treasurer. This Board of Directors will be responsible for the administration and representation of the fan club.

ARTICLE 5 – General Assembly.

Subject to the legislation in force at any given time, fan clubs registered in the Córdoba CF Official Fan Club Register must have a General Assembly made up of all members, which, as the sovereign body, can deliberate on any topic of interest, adopt agreements within its competence, and oversee the governing body.

ARTICLE 6 – Name of the fan club.

The name of the fan club must make reference to CÓRDOBA CF, and preferably to the territorial area where it carries out its activities. To avoid confusion, the use of identical or similar names that could be mistaken for those of existing clubs will not be permitted.

Names of fan clubs that go against the values of the Club, civic-mindedness, social integration, sportsmanship, solidarity, tolerance, non-racism, non-xenophobia, or that include expressions contrary to the law or which may violate fundamental rights will not be accepted.

To use as part of the name or identification of the fan club the name of a player (active or retired), coach, or member of the Board of Directors, authorisation must be obtained from the person concerned or from their family in the event of their death. In any case, the person whose name is to be used must have had a significant social connection with Córdoba CF.

ARTICLE 7 – Independence.

Córdoba CF shall not intervene in the creation, operation, and/or dissolution of any of its fan clubs, without prejudice to the collaboration it may offer in terms of providing information on creation, registration in the relevant association registers, and requirements for proper functioning, as well as possible events in which fan clubs may participate.

ARTICLE 8 – Obligations of fan clubs.

  • Respect Córdoba CF values, in addition to fostering unity among fans.

  • Notify the Club of all social activities related to Córdoba CF, as well as trips for matches played by any Córdoba CF team.

  • Fulfil any obligation arising from applicable laws, as well as respect this Regulation and the fan club’s internal Statutes.

  • Notify the Club of any change in the fan club’s Board of Directors.

  • Appoint a representative—who must be a member of the fan club’s Board of Directors and a season-ticket holder/supporter of Córdoba CF—to act as the intermediary with the Club.

  • Collaborate, to the extent possible, with initiatives and events in which the Club requests assistance.

  • Provide the Club annually, and whenever changes occur, with the names of the people in the fan club and its Board of Directors.

  • Notify the Club of any change in the fan club’s registered address, telephone number, or email address.

ARTICLE 9 – Use of the Club’s crest or symbols.

For any fan club to use the symbols, crests, logos, or other registered marks or images of Córdoba CF, prior written authorisation from the Club must be obtained.

In all cases, Córdoba CF is the sole owner of all rights to its identifying elements and related trademarks.

ARTICLE 10 – Official Córdoba CF Fan Club Register.

Córdoba CF, in compliance with its obligations, will maintain a Register of official fan clubs and supporters’ associations, in which those that meet the requirements set out in the following articles will be entered. This Register will be maintained exclusively online, on the Club’s Official Website. In this register, each Fan Club or Supporters’ Association shall include the information listed below, which must be provided by the clubs and/or associations themselves:

ARTICLE 11 – Declaration of Official Fan Club of Córdoba CF.

Once all the required documentation and information of the Fan Club or Supporters’ Association has been uploaded to the Club’s Official Website, it will be reviewed, and within thirty (30) days a Board Member, or any other person designated by the Club, will issue the corresponding decision—either granting the status of Official Fan Club in writing or rejecting the application if requirements are not met.

The Club will not review documentation until the Fan Club has uploaded all the information and documents mentioned in the previous article.

For fan clubs based in Córdoba city or province, at least five (5) members must be season-ticket holders/supporters for official recognition. For those based outside Córdoba and its province, at least three (3) members must be season-ticket holders/supporters.

Once registered, the official fan club will enjoy all the privileges and considerations granted by Córdoba CF.

ARTICLE 12 – Maintenance of official fan clubs.

All Official Fan Clubs undertake to maintain their organisation and operations active, complying with the formal requirements imposed by law and this Regulation.

ARTICLE 13 – Updating data.

Fan clubs must update their data once a year, between the end of the sports season and 30 September, notifying Córdoba CF via a certificate signed by the President and Secretary confirming maintenance and/or any changes.

Official Fan Clubs must also notify Córdoba CF immediately of:
- The holding of their annual assembly (with signed certificate by President and Secretary).
- Any change in Board of Directors positions, including the information required for the Official Fan Club Register.
- Annual member list.
- Any change in registered address, phone, or email.
- A documented report of all activities carried out during the season.

Clubs failing to comply, either voluntarily or after a request by the Club, may be deemed inactive and removed from the Official Fan Club Register at the Club’s sole discretion.

ARTICLE 14 – Non-compliance.

Fan clubs that violate this Regulation, damage the image and/or brand of the Club or that of any official fan club may be removed from the Register and lose their official status.

They may also lose this status if they engage in, promote, participate in, or disseminate acts contrary to the Law, especially the Sports Law.

Likewise, any that disrespect or undermine the Club’s values and/or image, misuse privileges, or cause any harm to the Club’s property, rights, or interests will lose their official status.

Removal from the Register may be temporary or permanent, depending on the seriousness of the acts or recurrence. The decision will be made by a Board Member or other person designated by the Club, after granting the fan club fifteen (15) days to present any arguments.

ARTICLE 15 – Communication of events.

Fan clubs must notify Córdoba CF of any trip, official event, or celebration related to the Club at least one month in advance.

ARTICLE 16 – Trips.

Any trip organised by an Official Fan Club for a Córdoba CF match must be communicated to the Club via the established channel, in order to comply with the travel protocol set out in Royal Decree 203/2010 of 26 February (or any future regulation replacing it). The fan club must provide the personal details of all travelling supporters attending the match.

ARTICLE 17 – Official events or celebrations.

Official Fan Clubs may organise any events they see fit, provided they respect their statutes and the Club’s values.

If they wish Córdoba CF representatives to participate, they must submit a proposal via the Club’s communication channel at least thirty (30) days before the event, including type of event, date, time, place, programme, estimated attendance, and details of any invited authorities.

The Club will decide whether to attend and which representatives will be present. If attending, the Club’s representative will be the highest authority present, along with any official authorities.

When selecting events to attend, the Club will prioritise:
- Inauguration of a newly established official fan club.
- Five-year anniversaries.
- 25th anniversary celebrations.
- Gatherings with other fan clubs.

Fan clubs should aim to hold events during the league’s final stages or holiday periods.

All communications from Official Fan Clubs to Córdoba CF must be made via the Club’s established channel, through the designated liaison. The Club may ignore communications from any other person claiming to act on behalf of the fan club.
